EU AI Act 2026: What Every Business Needs to Know Before August

Regulation (EU) 2024/1689 entered into force on August 1, 2024. The first prohibitions on unacceptable-risk AI practices took effect in February 2025. And on August 2, 2026, the next major wave hits: transparency obligations under Article 50, plus the requirement for AI literacy across organisations under Article 4.
If your business develops, deploys, or uses AI systems that interact with people in the EU — and that includes most businesses using AI in customer-facing operations — these deadlines apply to you. Regardless of where your company is headquartered.
Four months isn’t a lot of time. Here’s what you need to know.
What the EU AI Act Actually Requires
The Act classifies AI systems into four risk categories: unacceptable risk (banned), high risk (heavily regulated), limited risk (transparency obligations), and minimal risk (largely unregulated). Most business AI falls into the limited or high-risk categories.
The August 2026 deadline focuses on two areas that affect nearly every business using AI.
Transparency obligations (Article 50)
These are the rules that apply to the broadest range of businesses. If your AI system does any of the following, you must comply:
AI systems interacting with people. If your customers, employees, or partners interact with an AI system — chatbots, virtual assistants, AI-powered support tools — they must be clearly informed that they are interacting with AI. Not buried in terms of service. Clearly, at the point of interaction.
AI-generated content. If your business produces text, images, audio, or video using AI, that content must be marked as artificially generated. This applies to marketing materials, product descriptions, automated reports, AI-generated emails — anything that could be mistaken for human-created content.
Emotion recognition and biometric categorisation. If you use AI to detect emotions or categorise people based on biometric data, affected individuals must be informed. This extends to systems that analyse facial expressions in video calls, voice tone in customer service, or similar applications.
Deepfakes and synthetic media. Any AI-generated or manipulated content that depicts real people or events must be labelled as artificial. This covers everything from AI-generated product demonstration videos to synthetic voice used in automated calls.
AI literacy requirement (Article 4)
This one is broader than most businesses realise. Every organisation deploying AI must ensure that staff involved in operating or overseeing AI systems have “a sufficient level of AI literacy.” This isn’t a suggestion — it’s a legal requirement that also takes effect in August 2026.
What constitutes “sufficient” literacy depends on the context, but the Act specifies that it should account for the technical knowledge, experience, and education of the people involved, as well as the context in which the AI systems are used.
What Happens If You Don’t Comply
The enforcement structure has real teeth.
For transparency violations, fines can reach up to €15 million or 3% of annual global turnover, whichever is higher. For prohibited AI practices (already in effect since February 2025), fines go up to €35 million or 7% of turnover. For supplying incorrect information to regulators, up to €7.5 million or 1% of turnover.
Each EU member state is establishing its own national supervisory authority, and the European AI Office coordinates enforcement at the EU level. The first enforcement actions are expected to begin in late 2026.
Beyond fines, there’s a practical business risk. As AI regulation becomes normalised, customers, partners, and enterprise buyers will increasingly expect demonstrable compliance. Companies that can show they’ve built responsible AI practices will have a measurable advantage in procurement conversations and partnership discussions. This is particularly relevant if you serve enterprise clients or operate in regulated industries.
Who This Applies To
The short answer: almost certainly you, if you use AI in your business operations.
The Act applies to:
- **Providers** — anyone who develops an AI system or has one developed and places it on the market or puts it into service under their own name
- **Deployers** — anyone who uses an AI system in a professional capacity (this is most businesses)
- **Importers and distributors** — anyone bringing AI systems into the EU market
Critically, the Act has extraterritorial reach. If your AI system’s output is used within the EU, the Act applies — even if your company is based outside Europe. This mirrors the approach GDPR took, and businesses should expect similar enforcement reach.
Small and medium-sized enterprises get some accommodations — simplified compliance procedures and access to regulatory sandboxes — but they are not exempt from the core transparency and literacy requirements.
A Practical Compliance Roadmap
Compliance doesn’t require a massive overhaul if you start now. It requires a structured approach. Here’s what that looks like.
Step 1: Audit your AI inventory
Before you can comply, you need to know what you’re complying with. Map every AI system your business uses — not just the ones you built, but also third-party tools with AI capabilities. CRM features that use AI for lead scoring, email tools that generate content, analytics platforms that use machine learning for predictions.
For each system, document: what it does, what data it processes, who it interacts with, and which risk category it falls into under the Act. This inventory becomes the foundation of your compliance programme.

Step 2: Implement disclosure mechanisms

- Chatbots and virtual assistants need visible labels informing users they’re interacting with AI
- AI-generated content needs watermarking or labelling at the point of creation
- Automated decision-making systems need to explain their role in the process
- Emotion recognition systems need prior notification to affected individuals
The key principle is that disclosure must be clear, timely, and accessible. A footnote on page 47 of your terms and conditions doesn’t meet the standard.
Step 3: Build AI literacy in your team
Identify every role in your organisation that involves operating, overseeing, or making decisions based on AI systems. Then ensure those people understand: what the AI does, what its limitations are, how to interpret its outputs, and when to override or escalate.
This doesn’t require everyone to become a machine learning engineer. It means practical, role-specific training that gives people the confidence and knowledge to use AI tools responsibly. Document the training, because regulators will want to see it.
Step 4: Establish documentation and governance
The Act requires technical documentation for AI systems proportionate to their risk level. At a minimum, this should include:
- A register of all AI systems in use, their purposes, and their risk classifications
- Records of how transparency requirements are being met
- Evidence of AI literacy training
- Procedures for monitoring AI system performance and handling incidents
- A clear chain of responsibility for AI governance within the organisation
Step 5: Build compliance into your development process
If you’re building or customising AI systems, compliance needs to be part of the development lifecycle — not bolted on after deployment. This means incorporating transparency requirements into system design, testing disclosure mechanisms before launch, and including compliance review in your deployment checklist.
